MUHC Ordered to Pay $20,000 to Ex-Doctor for Searching His Medical Records and Revealing His Diagnosis
The McGill University Health Center (MUHC) was ordered to pay $20,000 dollars to Dr. Seang Lin Tan for searching his medical records and revealing that he had cancer, reported TVA News.
The judgment reveals that former Associate Director Dr. Timothy Meagher consulted Dr. Tan’s file twice while being treated for cancer at the Royal Victoria Hospital.
“No one should have access to a medical record without the patient’s consent. As a health professional, Dr. Meagher should have known, “writes David Collier in his judgment.
Dr. Tan, who is well known for having led for years the McGill Reproductive Center, at the time of his treatments, in 2009, had not informed most of his colleagues.
At a ceremony held by the hospital, another colleague revealed that he was battling cancer. “It was done without regard to Dr. Tan’s private life and caused him humiliation,” stated Justice Collier.
Claim for Lost Revenue and Income Rejected
Dr. Tran had also claimed C from the MUHC, for the loss of income in his new clinic, and millions of dollars in arrears while running the McGill Reproductive Center from 1996 to 2009.
The judge ruled that Dr. Tan was not entitled to these amounts, but ordered him to reimburse $ 271,000 for equipment purchased by the MUHC but used in his Decarie Boulevard clinic.
Dr. Tan has since filed an appeal of the decision.
